Terms of Service

These Terms of Service govern the use of the Skarbex platform in the Czech Republic. You accept them when you complete onboarding or when you later accept an updated version. If you do not agree, please do not use the platform.

Acceptance

Acceptance happens when you tick the agreement box during onboarding or when you are asked to accept a materially updated version. The version in force at the moment of an action governs that action; later versions are not applied retroactively unless mandatory law requires otherwise.

Definitions

  • Operator: Vladyslav Haiduk, sole trader (OSVČ), IČO 23484624. Full registration details are in the Imprint.
  • Platform: The Skarbex marketplace website at https://skarbex.com (and any subdomains), the related mobile views, the API, and any operator-controlled communication channels.
  • User: Any natural person who uses the platform, with or without an account.
  • Seller: A user who publishes a listing offering goods. Sellers may be private consumers (C2C) or businesses (B2C) that have completed business verification.
  • Private seller: A seller who acts outside a business or professional activity.
  • Business seller: A seller acting for business or professional purposes and marked as a business seller after approved business verification.
  • Buyer: A user who initiates contact with a seller about a listing or who agrees to acquire goods from a seller.
  • Listing: A published advertisement for goods created and maintained by a seller.
  • Imported listing: A public listing imported from Bazoš to help users discover goods and allow the source seller to claim or request removal.
  • Order tools: Optional tools for reservation, shipment tracking, meetup scheduling, pickup-code confirmation, cancellation requests, and help requests. They do not create escrow or platform payment handling.
  • Paid service: A digital service that the operator sells directly to a user — currently listing boosts and subscription plans.
  • Boost: A paid promotion that lifts a listing's visibility for a fixed time-window.
  • Subscription: A recurring fee plan that unlocks additional seller features.

Eligibility

You must be at least 16 years old to use Skarbex. You must have legal capacity to enter into the contracts these Terms create.

If you are 16 or 17, your parent or legal guardian must be aware of, and consent to, your use of Skarbex. By creating an account in that age range you confirm that this consent has been obtained.

Accounts

An account is created by registering with an email address or by using Google Sign-In. One person, one account; multiple accounts that circumvent suspensions or bans are not allowed.

You are responsible for keeping your credentials confidential, for everything that happens under your account, and for keeping your contact email up to date.

The operator may suspend or close an account if it believes the account violates these Terms, applicable law, or the rights of others. Where reasonable the operator will tell you why, and (for non-trivial cases) give you a chance to be heard before a permanent decision.

The operator's role on the platform

Skarbex is a marketplace. Sellers post listings, buyers see them, and the two parties communicate and arrange a transaction directly. The operator provides the technical environment that makes that possible.

The operator is NOT a party to any contract concluded between users about the goods. The contract about the goods is between the seller and the buyer; pricing, delivery, after-sales obligations, statutory warranty and any complaints about the goods are matters between those two parties. The platform's order tools exist solely to help buyer and seller coordinate — payment for the goods is arranged directly between them and never flows through the operator. The operator does not hold the goods at any point and does not guarantee that any listing is accurate or that any seller will perform.

Under EU and Czech rules on information-society services, the operator is a hosting service for user-generated content. The operator is not obliged to monitor the content users post, but will act on actual knowledge of unlawful content.

The contact email in the Imprint and the DSA Notice and Action Policy is the single contact point for notices about illegal content, authority/user notices and counter-notices. We review notices, may ask for clarification, may remove or restrict content/accounts, and where legally required give the affected user a statement of reasons and a way to respond.

Business sellers and trader disclosures

Business-seller features, storefront publication, stock listings and made-to-order listings may require an approved business verification. If verification is rejected, revoked, expired or needs changes, affected business features may be blocked or unpublished.

Business sellers must keep their legal name, registered address, public storefront identity, support contact details, and legally required return/complaint information accurate. Skarbex may display verified legal name and registered address on listing and storefront pages.

A business seller is responsible for consumer pre-contract information, statutory withdrawal rights, warranty/defect-liability rules, product-safety information, and after-sales obligations that apply to that seller under Czech and EU law. Skarbex is not the seller of the goods.

Your content

You keep all rights you have in the content you upload (listing text, photos, messages). You are responsible for having those rights — for example, that you own the photos you upload or have permission to use them.

By uploading content you grant the operator a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display and adapt the content as needed to run, promote and improve the platform, including in indexes, search results, social-media previews and similar surfaces. The licence ends when the content is deleted, except where retention is required by law or to defend legal claims.

The operator may remove or restrict content that violates these Terms, the law, or third-party rights. Where you submit a takedown notice, please use the address in the Imprint.

Imported Bazoš listings

Skarbex may display public listing information imported from Bazoš, including listing text, photos, category, price, source identifiers, and limited seller display/contact hints where available. Imported listings are discovery pages and are not Skarbex listings created by that seller unless claimed or converted through the platform flow.

If an imported listing relates to you, you may use the claim flow where available or contact [email protected] to request correction, removal, objection review, or information about the source data.

Prohibited content and conduct

The following are not allowed on the platform:

  • Goods or services whose sale is restricted or prohibited by Czech or EU law.
  • Counterfeit, replica or trade-mark-infringing goods.
  • Firearms, ammunition, weapons regulated under Act No. 119/2002 Coll. and similar.
  • Narcotic and psychotropic substances, including controlled precursors.
  • Live animals.
  • Adult, sexual or pornographic content.
  • Misleading, false or fraudulent listings, including hidden defects not disclosed in good faith.
  • Bulk unsolicited messages, spam or scraping of other users' contact details for off-platform commercial use.
  • Attempting to bypass moderation, ratings, suspensions, paid features, or platform fees.
  • Harassment, hate speech, threats, or content that targets a person or group based on protected characteristics.
  • Distributing malware, phishing links or attempting to access other users' accounts.
  • Unsafe products, recalled products, products missing legally required safety information, or products that cannot lawfully be supplied in the Czech Republic or EU.

Listings that violate these rules will be removed; accounts that repeat violations will be suspended or closed.

Product safety

Sellers must not list unsafe, recalled, counterfeit, illegally imported, or non-compliant goods. Business sellers are responsible for product-safety, traceability, instructions, warnings, manufacturer/importer information, and recall cooperation required by applicable law.

Paid services

Paid services are sold directly by the operator to you. Unlike contracts about goods between users, the contract for a paid service is between you and the operator.

Boosts

Boosts lift a listing's visibility for a fixed time-window stated at purchase. Performance begins immediately upon purchase after you request immediate performance and acknowledge the loss of withdrawal rights. The boost then operates for the purchased period. The operator does not guarantee any particular number of views, clicks or sales — boosts buy ranking placement, not outcomes.

Subscriptions

Subscriptions unlock additional seller features for the chosen billing period. They start immediately upon purchase after you request immediate performance and acknowledge the loss of withdrawal rights, and they operate until the end of the paid period. The price, billing period and included features are shown at purchase and may change for future periods on prior notice.

Subscriptions auto-renew at the end of each billing period at the then-current price unless cancelled in your billing settings. Cancellation stops future renewals and takes effect at the end of the current paid period; the plan stays active until then. Discounted or free promotional periods renew at the disclosed full price unless cancelled before renewal.

Payments

Payments are processed by Stripe. The operator does not see or store your full card number. Saved card details are stored as tokens by Stripe under your explicit consent at the moment you save the card; you can revoke that consent and delete the saved card at any time from your billing settings.

Right of withdrawal

At purchase for both boosts and paid subscriptions, you are asked to request immediate performance and acknowledge the resulting loss of the 14-day right of withdrawal. Once the purchase is confirmed, the paid service starts immediately and continues for the specified period. See the Refund Policy for the cancellation and no-refund rules.

Ranking and promoted listings

The default listing order may place active paid boosts above organic results. Promoted listings are labelled. Within the promoted group, active boosts are ordered by boost timing; organic listings then follow the selected sort such as newest first or price. Filters, category relevance, availability, moderation status, and imported/native source rules may affect whether a listing appears at all.

Reporting and moderation

If you see content or behaviour that breaches these Terms or the law, report it through the in-platform report tools or to the email in the Imprint. We log the report, review it, may ask for clarification, and take proportionate action where appropriate. Affected users can respond or send a counter-notice by email. Business sellers must keep their trader identity, contact and returns information accurate; where required, we may show that information to buyers, authorities and other legally entitled recipients.

Order coordination tools

Order tools help buyer and seller coordinate a transaction, but Skarbex does not handle payment for goods, hold money, provide escrow, inspect goods, guarantee delivery, or guarantee either user’s performance.

For home delivery, shipment tracking data may be shown when the seller registers tracking. The platform may auto-close a shipped order after the carrier marks it delivered and the help window expires, but that does not decide legal liability between buyer and seller.

For public meetup, the platform may issue a pickup code and may auto-cancel stale meetup orders according to the product flow. The users remain responsible for agreeing safe, lawful, and accurate handover terms.

Liability

The operator's liability is limited as follows:

  • Platform availability: The platform is provided as is and as available. The operator does not guarantee uninterrupted, error-free operation and will not be liable for short-term outages or downtime.
  • No guarantee for other users: The operator does not vet listings or users beyond what these Terms describe and does not guarantee the accuracy, legality or quality of any listing or the conduct of any user.
  • Third-party services: Stripe, Cloudflare, Hetzner, Google (including Google Workspace/Gmail SMTP), Twilio and any other disclosed sub-processors are independent providers; the operator is not liable for their outages or actions beyond what the law requires.
  • Force majeure: The operator is not liable for failures caused by events outside its reasonable control.

Nothing in this section limits any liability that under Czech mandatory law cannot be excluded — including for personal injury caused by the operator's intent or gross negligence, and for the consumer's statutory rights.

Termination

You can stop using the platform at any time. To request account deletion, write to the support email listed in the Imprint. Account deletion requests are processed within 30 days after verification; some records may be retained as described in the Privacy Policy.

The operator may terminate the agreement with you, with reasonable notice, if the platform is being discontinued, or immediately if you materially breach these Terms or the law.

Termination does not affect rights and obligations that by their nature survive — accrued payment obligations, retained accounting records, defending legal claims, and content licences for content that other users have already received.

Changes to these Terms

We may update these Terms. Material changes that require fresh consent are presented through the platform before continued use of affected features. Non-material clarifications take effect when published. The date above identifies the current version.
